Waiver and Release from Liability for all MetroConnected Sponsored Events
Through my electronic acceptance, I, the person identified in this electronic member registration, HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge MetroConnected, Inc., herein after MC, and its agents, employees, officers, directors, affiliates, successors, managers and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities, or acts by staff, employees, or management outside the scope of a particular event, conducted by, on the premises of, or for the benefit of, MC provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.
I understand that the activities in which I will participate are of a voluntary nature. I further understand that the Activities are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. I understand the nature of the Activities and acknowledge that I am qualified to participate in such Activities. I further acknowledge that I am aware that the Activities will be conducted in facilities open to the public. I agree and warrant that if at any time, I believe conditions to be unsafe I will immediately discontinue further participation in the Activities.
By this Waiver, I assume any risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with MC including but not limited to engaging in hosted or sponsored activities such as: wine tasting, restaurant dinners, networking mixers, sporting events, charity events, performing art productions, educational seminars, cooking classes, water skiing, snowboarding, snow skiing, boating, skydiving, rock climbing, mountain biking, whitewater rafting, sailing, and planned vacations.
By this Waiver, I assume the responsibility of notifying an agent MC for all guests that I invite or bring to a hosted or sponsored activity that are not registered members. I also assume the responsibility of notifying all guests that I invite or bring to a hosted or sponsored activity that acceptance of this Waiver is required before their participation.
This WAIVER AND RELEASE contains the entire agreement between the parties, and supercedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.
The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of SYP, whether by agreement, by operation of law, or otherwise.
I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by my electronic acceptance of this WAIVER AND RELEASE I have given up considerable future legal rights. I have accepted this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My electronic acceptance is my signature and proof of my intention to execute a complete unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 year of age or older and mentally competent to enter into this waiver. |

MetroConnected (MC) is committed to protecting your privacy. Under no circumstances will MC release your personal information to any third parties without your prior consent. This privacy statement explains data collecting and use practices of the MetroConnected.com site (the Site). By accessing the Site, you are consenting to the information collection and use practices described in this privacy statement. Visitors to the Site should be aware that you may be directed to other sites via links that are beyond the service and control of the Site. We have tried to identify these links wherever possible. These other sites may send their own cookies to users and collect or solicit personal data.
The Site may collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access the Site; the pages that you access while at the Site and the Internet address of the Web site from which you linked directly to our site. This information is used to help improve the site, analyze trends and administer the site. Some of our sites collect information about your hardware and software in order to provide a requested service. Windows Update, for example, needs to know information about your computer in order to recommend needed operating system updates.
For visitors that elect to become members (i.e., Free or VIP), MC will require information that personally identifies you (personal information) or allows us to contact you to provide a service or carry out a transaction that you have requested such as receiving electronic newsletters, surveys, receipts, and event notifications. The personal information we collect may include your name, email address, title, profession, company, salary, information about your job function, and credit card information.
You may change the status of receiving MC communications at any time. Under no circumstance will MC release your personal information to any third parties without your prior consent.
